It is at the discretion of the contractor to utilize any one of
the existing methods or new method. Any method selected must be
approved by the engineer prior to use. The engineer will review the
proposed method and approve or disapprove it.
The Contractor shall not use any method which has been found
unsuitable for similar conditions. Any such method shall be
revised or abandoned at the Contractor's expense.
Any deviation from the approved method must be submitted in
writing to the engineer for approval prior to implementation.
The contractor shall maintain records of all work performed,
including dates, times, personnel involved, and materials used.
These records shall be made available to the engineer upon
request.
The engineer may require the contractor to submit additionalindings or reports as deemed necessary for proper oversight.
Failure to comply with any of the above requirements may result
in the suspension of work until compliance is achieved.
The contractor shall not subcontract any portion of this work
without the prior written approval of the engineer.
The engineer reserves the right to terminate this agreement at
any time for cause, including but not limited to failure to meet
performance standards or repeated noncompliance with contractual
obligations.
All disputes arising from this agreement shall be resolved
through arbitration under the rules of the American Arbitration
Association.
The contractor agrees to indemnify and hold harmless theang engineer and any affiliated entities from all claims, damages,
or losses arising out of or related to the performance of this
agreement.
This agreement shall be governed by and construed in accordance
with the laws of the State of California.
